Terms of Service
1. Parties & acceptance
These Terms of Service (“Terms”) are a binding agreement between you and Muvelt Logistics LTD (“Muvelt,” “we,” “us”), a company incorporated in Ghana with registered address at [REGISTERED ADDRESS — to be supplied before publication].
By creating an account, verifying your phone number, or booking any trip or delivery via the Muvelt web app, mobile app, or any related service (together, the “Service”), you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility
- You must be at least 18 years old.
- You must hold a valid Ghana mobile phone number that can receive SMS.
- You must have the legal capacity to enter into a binding contract under Ghanaian law.
- You must not be barred from using the Service under any prior decision by Muvelt or by any applicable law.
3. Your account
You create your Muvelt account by entering your phone number and confirming the one-time passcode (OTP) we send by SMS. You are responsible for keeping access to your phone secure. Anyone who can receive your OTP can access your account. Notify us immediately at support@muvelt.com if you suspect unauthorised use.
You must provide accurate information (your name, addresses, and recipient details). We may suspend or terminate accounts using fake or misleading information.
4. The Service
Muvelt operates a technology platform that allows you to request deliveries and rides, and that connects you with independent riders willing to fulfil those requests. Muvelt does not itself transport packages or passengers. The transport service is provided directly to you by the rider you are connected with.
5. Independent riders
Riders on the Muvelt platform are independent contractors. They are not employees, agents, partners, or representatives of Muvelt. Muvelt does not control how a rider performs their work, the route they take, or the precise time they will arrive (beyond providing estimates).
Muvelt does, however, verify rider identity documents, motorbike registration, and may suspend riders who breach the standards in these Terms or our rider agreement.
6. Booking & pricing
Prices shown in the app at the time you book are quotes based on distance, route, service type, and current platform settings. The final price may differ if the actual pickup or delivery location materially differs from what you entered, if you change the destination en route, or if waiting time exceeds reasonable limits. We will tell you the final price before the trip is marked complete.
If you used our price-bidding feature, the price you accepted from a rider's offer is binding once accepted.
7. Payment
Payment is made directly to your rider in cash or via mobile money at the time of the trip. Muvelt does not currently process payments on its own account, except for its commission, which is collected from the rider's earnings according to our rider agreement.
You agree to pay the agreed price in full at the end of the trip. Non-payment is a breach of these Terms and may result in suspension of your account, referral to debt-collection services, or legal proceedings.
8. Cancellation & no-shows
- You may cancel an order free of charge before a rider is assigned, or within a short grace period after assignment (currently 2 minutes).
- Cancellations after the rider has begun travelling toward your pickup may incur a cancellation fee to compensate the rider, displayed in the app before you confirm.
- If you are not at the pickup location when the rider arrives, we will hold the order for a reasonable waiting period; after that, the order may be cancelled and a no-show fee charged.
- Riders may also cancel for valid reasons (e.g. unsafe conditions, suspected fraud, illegal packages); in such cases you will not be charged.
9. Your obligations
- Provide accurate pickup and delivery addresses, recipient details, and a working phone number.
- Be present and ready at the pickup point at the booked time.
- For deliveries, accurately describe the package and its contents.
- Pay your rider the full agreed amount at the end of the trip.
- Treat your rider with respect and follow lawful safety instructions (helmet, seating, etc.).
- Comply with all applicable Ghanaian laws while using the Service.
10. Prohibited use
You may not use the Service to:
- Send or transport any illegal items, including but not limited to controlled drugs, firearms, explosives, stolen goods, counterfeit currency, or restricted wildlife products.
- Send any item that is hazardous, perishable beyond reasonable handling, or that requires a special licence Muvelt and the rider do not hold.
- Send items above reasonable size and weight limits for a motorbike (broadly: 30 kg, 50 × 40 × 30 cm — riders may refuse oversize packages on arrival).
- Use the Service to harass, threaten, defraud, or stalk any person, including your rider or the recipient.
- Reverse-engineer, scrape, automate, or attempt to gain unauthorised access to any part of the Service.
- Impersonate another person or create multiple accounts to evade a suspension.
Violation of this section may result in immediate account termination, forfeiture of any unpaid balances, and referral to law enforcement.
11. Ratings & conduct
After a trip, you can rate your rider and leave a comment. Ratings must reflect your honest experience and must not contain abusive, defamatory, or discriminatory content. We may remove ratings that breach this rule.
12. Intellectual property
All trademarks, logos, source code, designs, and content on the Service are owned by Muvelt or its licensors. You receive a limited, non-exclusive, non-transferable, revocable licence to use the Service for its intended purpose. You may not copy, modify, redistribute, or create derivative works of any part of the Service without our prior written permission.
13. Disclaimer of warranties
The Service is provided “as is” and “as available”. To the maximum extent permitted by Ghanaian law, Muvelt disclaims all warranties — express or implied — including fitness for a particular purpose, merchantability, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any rider will be available at any given time.
14. Limitation of liability
To the maximum extent permitted by law, Muvelt's total aggregate liability arising out of or in connection with the Service, whether in contract, tort, or otherwise, is limited to the amount you paid for the specific trip giving rise to the claim, or GHS 500, whichever is greater.
Muvelt is not liable for indirect, incidental, consequential, special, or punitive damages, including loss of profits, loss of goodwill, or loss of data, even if advised of the possibility of such damages.
Nothing in these Terms excludes or limits liability for death, personal injury caused by negligence, or fraud, where such exclusion is prohibited by Ghanaian law.
15. Indemnification
You agree to defend and indemnify Muvelt and its officers, directors, employees, and agents against any claim, loss, damage, or expense (including reasonable legal fees) arising out of: (a) your breach of these Terms; (b) your misuse of the Service; (c) your violation of any law; or (d) your violation of any third-party right, including the rights of your rider or any recipient.
16. Suspension & termination
We may suspend or terminate your account at any time if we reasonably believe you have breached these Terms, presented a safety risk, or where required by law. You may stop using the Service at any time by signing out and contacting us to delete your account; certain order records must be retained for the periods set out in the Privacy Policy.
17. Changes to these Terms
We may update these Terms from time to time. When changes are material, we will notify you in-app or by push notification at least 14 days before the change takes effect. Continued use of the Service after the effective date constitutes acceptance of the new Terms.
18. Governing law & disputes
These Terms are governed by the laws of the Republic of Ghana. Any dispute arising out of or in connection with these Terms or the Service shall first be addressed through good-faith negotiation. If unresolved within 30 days, the dispute shall be referred to the courts of Ghana, which shall have exclusive jurisdiction.
